Terms and Conditions for Electronically-Supplied Services
effective as of 02.01.2018
Based on Article 8(1)(1) of the Act of 18 July 2002 on Electronically-Supplied Services (uniform text of 2017, item 1219 as amended) Triploca sp. z o.o. hereby establishes these Terms and Conditions for Electronically-Supplied Services (further referred to as the "T&Cs").
These T&Cs set out the terms and technical conditions for the supply of electronic services by Triploca sp. z o.o. through its internet Platform available at www.triploca.com.
The T&Cs are available on www.triploca.com website in two language versions: Polish and English.
The T&Cs are made available free of charge in a form that makes it possible to obtain, reproduce, record and print them.
The phrases used in these T&Cs should be understood as follows:
Triploca - Triploca sp. z o.o. with its registered office in Warsaw (00-571), Al. Armii Ludowej 6/164, registered in the District Court for the Capital City of Warsaw, 12 Commercial Division of the National Court Register (KRS), NIP (Tax Identification Number) 7010666135, with firstname.lastname@example.org as its e-mail contact address. Triploca provides the Services specified in these T&Cs for Users via the Platform.
The T&Cs - this document setting out the terms and conditions for the supply of services electronically by Triploca as part of the Platform;
The Platform - organised information and IT platform connected to the internet, created by Triploca, providing Users with access to IT mechanisms, databases and information developed by Triploca in order to supply services, available at www.triploca.com;
Services - services supplied by Triploca electronically specified in the T&Cs;
The Act - Act of 18 July 2002 on Electronically-Supplied Services (Journal of Laws No. 144, item 1204 as amended);
Organiser - a travel agency or organiser of tourist tours, providing services that involve organisation of trips, tours or tourist events,
Seller's (Organiser's) Account - individual Organiser's Account created as part of the Platform and secured with an Organiser’s unique identification data (login and password), enabling an Organiser to offer trips, sell products, tours or tourist events to other Users of the Platform.
User - a person using the Platform. A User of the Platform is both an Organiser, as well as any person interested in using services provided by Organisers upon the terms and conditions set out in the T&Cs.
User's Account - an individual User's Account created as part of the Platform and secured with a User's unique identification data (login and password), enabling a User access to the trips, tours or tourist events offered by Organisers through the Platform.
Terms and conditions for entering into and termination of Agreements
Once a User has submitted a statement on the acceptance of the T&Cs and started using the Services offered by Triploca (covered by the "T&Cs"), it means they have accepted the terms and conditions of these T&Cs and is equivalent to entering into an Agreement with Triploca. The T&Cs constitute an integral part of an Agreement made with a User.
An additional condition for an Organiser to start offering Services through the Platform is registration and opening a Seller's (Organiser's) Account via the Platform. In order to register an Organiser, all data regarding an Organiser required by Triploca must be provided, as well as a scan of a document with a photo (passport, identification document, driving licence) of an Organiser or a person acting on its behalf, sent via the Platform or to Triploca's e-mail.
In order to become a User of the Platform, it is possible to open a User's Account or use an Organiser's offer via the Platform on an occasional basis by providing basic data required by Triploca.
A User may stop using a Service at any time.
Triploca, upon an Organiser's request, closes that Organiser's Account created as part of the Platform within 14 days of receipt of an appropriate request from an authorised person. If any justified doubts arise regarding authorisation of a given person to request closing an Organiser's Account, Triploca may make the closing of an Account conditional upon providing additional information and/or documents by the person making a request. In such a case, an Organiser's Account will be closed after providing the required information and/or documents.
Triploca, upon a User's request, closes that User's Account created as part of the Platform within 14 days of receipt of an appropriate request from an authorised person. If any justified doubts arise regarding authorisation of a given person to request closing a User's Account, Triploca may make the closing of an Account conditional upon providing additional information and/or documents by the person making a request. In such a case, a User's Account will be closed after providing the required information and/or documents.
Types of electronically-supplied services
Triploca makes the following Services accessible to its Users via the Platform:
access to the database of travel agencies and organisers of tourist tours, as well as access to up-to-date offers of those Organisers,
enabling Organisers to present up-to-date offers of trips, products, tours or tourist events,
comparison of terms and conditions of trips, tours or tourist events offered by particular Organisers.
d) access to information on services offered by particular Organisers based on information and ratings given by other Users,
entering into agreements between a User and an Organiser selected by a User for a trip, event or a tour chosen by that User,
possibility of placing adverts as part of the Platform, upon the terms and conditions agreed separately between Tripcola and a person or a business interested in placing an advert.
Services offered on the Platform may be used after a User logs on to www.triploca.com portal. A User may log on to www.triploca.com Portal only after accepting the content of these T&Cs.
An Agreement between a User interested in purchasing a trip, tourist event or a tour and an Organiser is made in English or another language accepted by a User and its selected Organiser.
The price for a Service offered by an Organiser is calculated after a User selects an itinerary and time of a trip, tourist event or a tour, specifying the number of participants and entering the required data into the calculator placed on www.triploca.com website.
An Agreement between a User interested in purchasing a trip, tourist event or a tour and an Organiser is made by a User's acceptance of a specific offer from a selected Operator and after payment of the price or a deposit for participation in a trip or a tour via the payment facility available as part of the Platform.
If a User decides to pay a deposit for participation in a trip or a tour, the remainder of the price must be paid directly to an Organiser of a trip or a tour on the day it starts at the latest.
Triploca confirms that an Agreement was made between a User interested in purchasing a trip, tourist event or a tour and an Organiser by sending information to a User's e-mail address and an Organiser's e-mail address.
A User is obliged to follow the terms and conditions of the T&Cs and detailed instructions published on www.triploca.com website.
A User must not make available to any third parties the Login or the Password to a User Account created as part of the Platform.
It is prohibited to create a fake Organiser's Account as part of the Platform and to present false or untrue offers of trips, tours or tourist events.
It is prohibited for a User to sent via the Platform any information or content that is illegal, offensive, incorrect or misleading information, as well any content with viruses or that may interfere with or damage the computer systems.
If a User undertakes any illegal activities, in particular any of the activities set out in § 7 sections 2-4, Triploca is entitled to immediately block a User's Account or an Organiser's Account that was used for such purposes and to seek compensatory claims directly from such a User or Organiser.
If any justified doubts arise regarding the use of a User's Account or an Organiser's Account that is contrary to the T&Cs, Triploca has the right to temporarily block such an Account until necessary explanations have been made by a User or an Organiser.
Method of making and examining complaints
A User may submit at any time any reservations concerning the services provided by Triploca, including complaints and grievances ("complaints"). Prompt submission of complaints after a User has learnt about any reservations will facilitate and speed up fair examination of complaints.
Complaints may be submitted:

A complaint should include a User's or an Organiser's data that enable its identification, details of a purchased trip, event or a tour and the reservations submitted by a User or an Organiser.
At a User's request, Triploca will confirm receipt of a complaint electronically or by another method agreed with a User.
Triploca examines a complaint immediately after its receipt. A reply to a complaint is made without undue delay, but not later than 30 days of the day of receipt of the complaint, unless particularly complicated circumstances have occurred that prevent examination and reply within that time limit. In such a case, Triploca will inform a User that submitted a complaint of the grounds of the delay, circumstances that need to be established in order to examine the case and specify the expected time limit for examination of the complaint and reply, which may not exceed 60 days following receipt of the complaint.
A reply to a complaint is made by electronic mail.
Limitation of Triploca's liability
Triploca as an entity that provides access to the Platform matching Users interested in purchasing a trip, event or a trip with Organisers, will not be held liable for consequences of activities of Organisers or other Users.
2. Triploca will not be held liable in the event Services are provided improperly if this results from a breach of these T&Cs by a User. A User bears the risk resulting from it providing false or inaccurate information or statements.
3. Triploca does not guarantee that the Platform works in an uninterrupted and correct manner at all times; however, it undertakes to take all possible efforts and measures to ensure that the Platform operates properly.
4. Triploca will not be held liable for any delays, interruptions, losses resulting from defects in any electronic or mechanical equipment that does not belong to Triploca, for problems during data transfers or connections that occurred on the grounds not attributable to Triploca, for the quality of channels of public communication through which the Platform is accessible or if access to the Platform is blocked as a result of activities of third parties.
Triploca, as part of its Services, processes Users' personal data for purposes related to the use of the Platform pursuant to the Act of 29 August 1997 on Personal Data Protection (uniform text, Journal of Laws of 2014, item 1182, as amended).
Triploca is Users' data controller.
Consent to process personal data as part of the Platform may be cancelled at any time by Users in the form of a written statement sent to Triploca's address. Cancellation of consent is equivalent to resignation from the use of the Platform and termination of the Agreement.
In matters that are not regulated in the T&Cs, general provisions of Polish law will apply.
Numbering and titles of editing units are for information purposes only.
If the T&Cs are changed, new T&Cs will be published on the website of www.triploca.pl Platform.
These T&Cs have been approved based on a decision of the Management Board of Triploca sp. z o.o. of 02.01.2018.
Returns and Refunds Policy
Thank you for shopping at Triploca.com.
We do not issue refunds for our products once the order is confirmed. After order returns or refunds are dependent on tour operators conditions. Tour agents may carry special restrictions and conditions, for example in respect to cancellation or refund.
